Examination achievement PL1

  • Form of examination: written exam (Klausur) (90 Min.)
  • Examination Frequency: each semester
    Successful completion of the compulsory elective subject examinations within an examination period (a total of 9 CP). The examinations must be taken in writing. The examination time for each compulsory elective subject is 90 minutes.

Evaluation of grades

All partial module examinations have to be passed. The module grade is the arithmetic mean of all partial examination grades.

The overall mark is calculated from the average of the individual marks.

Contents

The lecture “Intellectual Property” deals with national, European and international aspects of Intellectual Property Law.

The following content is subject of the lecture:

  • Patent Law / Utility Patent Law
  • Variety Protection
  • Protection of Signs (Trade Mark Law)
  • Design Law
  • Copyright
The lecture is dedicated to Patent Law as part of Intellectual Property. In particular, the patent requirements, the invention concept, software patents, patents related to biotechnology, the patent procedure and patent infringement are considered, as well as the basics of the patent evaluation and patent management. In addition, the lecture provides insights into European Patent Law (WTO, TRIPs) and international patent-related convenient.
The lecture deals with selected aspects of Engineering and Law, in particular:
  • Product liability (warranty law, product liability, manufacturer liability)
  • Protection of innovation (innovation concept, protective measures, patents vs. secrecy, open innovation)
  • E-Markets (Internet Law, E-Commerce)
The subject of the lecture is Competition Law in the broader sense. This includes the Fair Trading Law (UWG) as well as the Cartel Law (GWB/AEUV) on a German and European level.

Competencies / intended learning achievements

Upon successful completion of the module, students will be able to
  • distinguish between the different protection options and their requirements
  • evaluate the possible applications of the different intellectual property rights from an economic and legal point of view
  • assess the legal admissibility of different measures in operation
  • decide on the meaningfulness of legal and strategic protective measures in innovation processes
